There are two types of patents:
- Invention: granted for 20 years.
- Utility model: granted for 15 years.
The protective scope of these patents is very wide and a simple change to a detail will not allow third parties to violate it. Any product's conflict or not requires the analysis of some aspects, such as: generated technical effect, best use, useful purpose, etc.
In addition to the types of patents mentioned above, the Law saves the Registration of Industrial Designs (granted for 10 years, extendable for over 15 years), which has for its purpose to protect exclusively the product's design with the advantage the registration is granted by INPI in about six (06) months.
